Privacy Notice
This Privacy Notice describes how Prodigies AI LLC ("Prodigies AI," "we," "us," or "our"), a Florida limited liability company, handles personal information through prodigies.ai, app.prodigies.ai, and our AI front desk services.
1. Scope and our role
This notice applies to website visitors, account owners, authorized users, prospective customers, and individuals who communicate with a Prodigies AI-powered service. For account, billing, sales, and website information, Prodigies AI determines why and how information is used. For calls, messages, appointment details, and other information handled on behalf of a business customer, that customer generally determines the purpose of processing and Prodigies AI acts as its service provider or processor.
2. Information we handle
- Account and business information: names, business contact details, login credentials, team information, services, hours, policies, calendars, and configuration choices.
- Customer communications: caller names and contact details, appointment requests, call metadata, messages, transcripts, summaries, and recordings when recording is enabled and legally permitted.
- Payment information: subscription and transaction status. Full payment card details are collected and processed by our payment provider, not stored by Prodigies AI.
- Technical and security information: IP address, device and browser information, logs, authentication events, and fraud-prevention signals.
- Support and feedback: requests, troubleshooting information, product feedback, and communications with our team.
3. How we use information
We use information to provide and secure the service; create and administer accounts; configure AI agents; answer and route communications; coordinate appointments; integrate authorized calendars and business systems; process subscriptions; provide support; investigate abuse; comply with law; and improve the customer-specific service through quality review, analytics, and approved configuration changes.
Prodigies AI does not sell personal information or share it for cross-context behavioral advertising. We do not use Customer Content to train a generalized model for unrelated customers unless the customer separately gives express written permission.
4. Service providers and disclosures
We disclose information only as reasonably necessary to operate the service, follow customer instructions, protect rights and security, complete a business transaction, or comply with law. Carefully selected service providers may process information for cloud hosting, communications, AI processing, payments, scheduling integrations, email delivery, security, and support. They may process information only as necessary to perform their authorized services and are subject to contractual privacy and security obligations. Business customers may request additional information about providers applicable to their service.
5. Call recording and consent
Important: A business customer that enables recording or transcription is responsible for providing legally required notices and obtaining legally required consent. Florida law generally requires prior consent from all parties to intercept or record a communication. Prodigies AI can configure an announcement and should not be used to record a caller who has not provided required consent.
6. Health and other sensitive information
The standard service is not offered as a HIPAA-compliant service. Protected health information may be processed only after Prodigies AI and the customer have executed a Business Associate Agreement and the applicable account, vendors, retention controls, and workflows have been approved and configured for that use. Customers must not submit Social Security numbers, full payment card numbers, account passwords, or other unnecessary sensitive information.
7. Retention and deletion
Retention depends on the service configuration, legal requirements, security needs, and our agreements with the customer. We retain account and transaction records as needed to administer the relationship and meet legal obligations. Customer Content is retained only as reasonably necessary for the service and configured workflows. Customers may request deletion, subject to legal, security, backup, and contractual limitations.
8. Security
We use administrative, technical, and organizational safeguards designed for the nature of the information we handle, including access controls, tenant separation, encryption in transit, credential protection, monitoring, and restricted administrative access. No system can guarantee absolute security.
9. Choices and requests
Account users may request access, correction, deletion, or export of applicable information by contacting us. When we process information for a business customer, callers and end users should direct privacy requests to that business; we will assist the business as required by our agreement and applicable law.
10. Children, transfers, and changes
The service is designed for businesses and is not directed to children under 18. Information may be processed in the United States and other locations where authorized providers operate. We may update this notice as the service or law changes. Material changes will be posted here and, when appropriate, communicated to account owners.

Terms of Service
These Terms govern business use of the Prodigies AI website, portal, AI front desk, integrations, and related services. By creating an account, accepting an order, or using the service, the customer agrees to these Terms.
1. Business agreement and authority
The service is offered for business use. The individual accepting these Terms represents that they are at least 18 and authorized to bind the identified business ("Customer"). These Terms, an applicable checkout or order form, and any signed addendum form the agreement between Customer and Prodigies AI LLC.
2. Service
Prodigies AI provides configurable software that may answer and route communications, retrieve approved business information, coordinate appointments, connect authorized systems, and produce operational records or summaries. Features depend on the purchased configuration, third-party availability, and Customer-provided information.
3. Customer responsibilities
Customer must provide accurate services, prices, hours, staff, policies, schedules, disclosures, and escalation instructions; maintain authorized access to connected systems; review configurations before launch; supervise outputs; and promptly correct inaccurate information. Customer remains responsible for its business decisions, professional services, customer relationships, legal notices, and compliance obligations.
4. AI limitations and human oversight
AI output can be incomplete or incorrect. The service is not a medical, legal, financial, emergency, or other licensed professional. Customer must maintain appropriate human escalation, must not rely on the service for emergency response, and must independently verify material decisions, quotes, eligibility, availability, and regulated advice.
5. Recording, transcription, and communications law
Customer may enable recording or transcription only when lawful. Customer is responsible for notices, consents, scripts, and jurisdiction-specific requirements for callers and staff. Where all-party consent is required, including generally under Florida law, Customer must obtain consent before recording. Customer is also responsible for telemarketing, text messaging, do-not-call, and other communications laws applicable to its campaigns and contacts.
6. Privacy, Customer Content, and HIPAA
Customer retains ownership of information, recordings, documents, and instructions it submits or causes the service to process ("Customer Content"). Customer grants Prodigies AI and its authorized providers a limited right to process Customer Content to provide, secure, support, and improve the customer-specific service. Customer represents that it has the rights and lawful basis required to provide that content.
Unless a Business Associate Agreement has been signed and a HIPAA-enabled environment has been expressly approved, Customer must not use the service to create, receive, maintain, or transmit protected health information.
7. Fees, renewal, and cancellation
Subscription fees, included usage, overages, and billing frequency are disclosed at checkout or in an order form. Subscriptions renew monthly unless otherwise stated. Customer authorizes recurring charges until cancellation. Customer may cancel through the available account or support method; cancellation takes effect at the end of the current paid billing period unless otherwise required by law or stated in an order form. Fees are non-refundable except as required by law or expressly agreed in writing. Customer is responsible for applicable taxes.
8. Third-party services
The service may depend on providers such as telephony, AI, cloud hosting, payment, calendar, and security platforms. Their availability, terms, and technical limits may affect the service. Customer authorizes Prodigies AI to exchange information with integrations Customer enables. Prodigies AI is not responsible for a third-party service outside its reasonable control.
9. Intellectual property
Prodigies AI and its licensors retain rights in the platform, software, workflows, templates, documentation, designs, and improvements. Customer receives a limited, non-exclusive, non-transferable right to use the service during the subscription term. Customer may not copy, resell, reverse engineer, bypass access controls, or use the service to build a competing product except where law prohibits that restriction.
10. Confidentiality
Each party will use the other party's non-public business information only for the agreement and protect it using reasonable care. Confidentiality obligations do not apply to information lawfully known without restriction, independently developed, publicly available through no breach, or lawfully received from another source. Required legal disclosures must be limited where reasonably possible.
11. Suspension and termination
Prodigies AI may suspend access for nonpayment, security risk, unlawful use, material breach, or conduct that threatens callers, customers, providers, or the platform. Either party may terminate for an uncured material breach after reasonable written notice when cure is possible. Provisions intended by their nature to survive will survive termination.
12. Warranties and disclaimers
Prodigies AI will provide the service with commercially reasonable care. Except for that commitment and any express written warranty, the service is provided "as is" and "as available." To the maximum extent permitted by law, Prodigies AI disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
13. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenues, goodwill, or data. Except for payment obligations, infringement or misuse of the other party's intellectual property, confidentiality breaches, unlawful conduct, indemnity obligations, or liability that cannot legally be limited, each party's aggregate liability arising from the service will not exceed the fees paid or payable by Customer for the service during the twelve months before the event giving rise to the claim.
14. Indemnification
Customer will defend and indemnify Prodigies AI against third-party claims arising from Customer Content, Customer's services or instructions, unlawful recording or communications, Customer's violation of law, or use prohibited by the Acceptable Use Policy. Prodigies AI will provide reasonable notice and cooperation and allow Customer to control the defense, subject to reasonable protection of Prodigies AI's interests.
15. Governing law and disputes
Florida law governs the agreement without regard to conflict-of-law rules. The state and federal courts located in Broward County, Florida will have exclusive jurisdiction, and each party consents to those courts. Before filing a claim, the parties will attempt in good faith for at least 30 days to resolve the dispute through written notice and business discussion.
16. Changes and notices
We may update these Terms for legal, security, or service changes. Material changes will be posted and communicated when appropriate. Changes do not retroactively reduce rights for a dispute that arose before the effective date. Notices to Prodigies AI must be sent to legal@prodigies.ai.
